O atestado possui intrinsecamente essa finalidade. Seu conte\u00fado \u00e9 de inteira responsabilidade do m\u00e9dico e, conforme a Resolu\u00e7\u00e3o CFM 1.685\/2002, o atestado deve conter o tempo concedido de dispensa ao trabalho, o diagn\u00f3stico (se autorizado pelo <\/span><a href=\"https:\/\/www.vydence.com\/pt-br\/tipos-de-pacientes\/\"><span style=\"font-weight: 400;\">paciente<\/span><\/a><span style=\"font-weight: 400;\">), assinatura e carimbo com o n\u00famero do registro profissional do CRM.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mas muito se pergunta sobre a obrigatoriedade do CID no atestado. Veja algumas considera\u00e7\u00f5es sobre o assunto!<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Leis sobre inser\u00e7\u00e3o de CID no atestado<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Duas resolu\u00e7\u00f5es do Conselho Federal de Medicina e algumas decis\u00f5es dos tribunais de trabalho tratam sobre o CID no atestado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Resolu\u00e7\u00f5es do Conselho Federal de Medicina<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"http:\/\/portal.cfm.org.br\/index.php?option=com_content&amp;id=2617\"><span style=\"font-weight: 400;\">Resolu\u00e7\u00e3o CFM 1.658\/2002<\/span><\/a><span style=\"font-weight: 400;\"> normatiza a emiss\u00e3o de atestados m\u00e9dicos. De acordo com seu artigo 5\u00ba, \u201cos m\u00e9dicos somente podem fornecer atestados com o diagn\u00f3stico codificado ou n\u00e3o quando por justa causa, exerc\u00edcio de dever legal, solicita\u00e7\u00e3o do pr\u00f3prio paciente ou de seu representante legal\u201d. Quando houver a solicita\u00e7\u00e3o de coloca\u00e7\u00e3o de CID no atestado, a concord\u00e2ncia do paciente ou de seu represente deve estar expressa no atestado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A <\/span><a href=\"http:\/\/www.portalmedico.org.br\/resolucoes\/CFM\/2007\/1819_2007.htm\"><span style=\"font-weight: 400;\">Resolu\u00e7\u00e3o CFM 1.819\/2007<\/span><\/a><span style=\"font-weight: 400;\"> trata do assunto de forma ainda mais taxativa. No artigo 1\u00ba, ela veda \u201c<\/span><i><span style=\"font-weight: 400;\">ao m\u00e9dico o preenchimento, nas guias de consulta e solicita\u00e7\u00e3o de exames das operadoras de planos de sa\u00fade, dos campos referentes \u00e0 Classifica\u00e7\u00e3o Internacional de Doen\u00e7as (CID) e tempo de doen\u00e7a concomitantemente com qualquer outro tipo de identifica\u00e7\u00e3o do paciente ou qualquer outra informa\u00e7\u00e3o sobre diagn\u00f3stico, haja vista que o sigilo na rela\u00e7\u00e3o m\u00e9dico-paciente \u00e9 um direito inalien\u00e1vel do paciente, cabendo ao m\u00e9dico a sua prote\u00e7\u00e3o e guarda<\/span><\/i><span style=\"font-weight: 400;\">.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Entendimento do Tribunal Superior do Trabalho<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">O Tribunal Superior do Trabalho, em uma de suas se\u00e7\u00f5es, tamb\u00e9m j\u00e1 se decidiu pela ilegalidade da inser\u00e7\u00e3o do CID no atestado m\u00e9dico, com a finalidade de abonar a falta do trabalhador. Para os ministros, tal inser\u00e7\u00e3o violaria garantias constitucionais, motivo pelo qual tal informa\u00e7\u00e3o n\u00e3o pode integrar o atestado, exceto se por solicita\u00e7\u00e3o do paciente ou de seu representante legal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Apesar disso, cabe destacar que essa exig\u00eancia est\u00e1 prevista, de maneira equivocada, na Portaria 3291\/84, do Minist\u00e9rio da Previd\u00eancia e Assist\u00eancia Social (artigo 2\u00ba, inciso \u201cb\u201d).<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Prote\u00e7\u00e3o da privacidade<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">O maior fundamento para a n\u00e3o inser\u00e7\u00e3o do CID no atestado m\u00e9dico \u00e9 a prote\u00e7\u00e3o da privacidade. A <\/span><a href=\"https:\/\/www.vydence.com\/pt-br\/relacao-medico-paciente\/\"><span style=\"font-weight: 400;\">rela\u00e7\u00e3o m\u00e9dico-paciente<\/span><\/a><span style=\"font-weight: 400;\"> \u00e9 orientada pela confian\u00e7a entre as partes. Qualquer caracter\u00edstica do tratamento de sa\u00fade e provid\u00eancias a serem tomadas nele devem ser descritas no prontu\u00e1rio m\u00e9dico, documento com car\u00e1ter sigiloso e cient\u00edfico, de imensa valia para todos os envolvidos nele. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">A ideia de inserir dados no prontu\u00e1rio \u00e9 exatamente preservar a privacidade e a intimidade, j\u00e1 que \u00e9 o paciente o propriet\u00e1rio dessas informa\u00e7\u00f5es, apesar de o documento ficar sob a responsabilidade do m\u00e9dico ou da institui\u00e7\u00e3o de sa\u00fade.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Quando as normas pro\u00edbem a inser\u00e7\u00e3o do CID no atestado, fazem prevalecer a confian\u00e7a p\u00fablica depositada no m\u00e9dico para que seu servi\u00e7o seja executado com presteza e seguran\u00e7a. Caso contr\u00e1rio, se houvesse divulga\u00e7\u00e3o do segredo, seria como se ocorresse uma quebra de confian\u00e7a, uma invas\u00e3o \u00e0 privacidade. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Os m\u00e9dicos n\u00e3o devem inserir o CID no atestado, salvo por pedido expresso de seu paciente ou de seu representante legal.
